In June 2017, under pressure from the EU Commission, the EPO Board of Directors, which includes 38 member states, introduced a clause prohibiting patents on plants and animals from traditional breeding practices. However, the EPO considers animals and plants patentable if they meet criteria such as novelty. This has moved us to Dr. med. jur. Thomas Büttner LL. M. in a statement to the Federal Ministry of Justice and Consumer Protection to respond clearly.
